Can't see what difference the lack of MOT makes to an insurance theft claim. If he'd been riding it on the road at the time I could understand it.

At worst I'd expect them to try & chip a few quid off the value, but to refuse to pay out altogether is bollox. Sounds like a call to the insurance ombudsman is needed to me.

Is it a condition of the policy that the vehicle must be mot'd? I have never heard that before.

Just because the vehicle has not got a valid mot it is not a reason for the insurance not to pay out.
If you do a web search you will find they have to pay out,my mate wrote his merc off with no mot and the insurance paid out.

in 2009 had a bump in a car with mot expired (i knew) insurance paid out was £50 less due to mot expired,
i was fully comp so dont know if that made a difference ????

I had 1 nicked no mot or tax told them it was stored over the winter no need for mot or tax it was in a garage.
